These Terms of Service apply to purchases made through the Sam’s Spares website and your use of our online store.

About Sam’s Spares

Sam’s Spares Inc is an Australian not-for-profit organisation and social enterprise based in Western Australia. We refurbish and sell donated technology, with proceeds supporting our charitable purpose of improving digital access and creating employment and training opportunities.

Products and refurbished technology

Most technology sold by Sam’s Spares is refurbished or pre-owned unless otherwise stated.

All refurbished devices are tested and prepared for sale before being listed. As refurbished products, devices may show reasonable signs of previous use or cosmetic wear. We aim to describe the condition and specifications of products accurately.

Product photographs may be representative where we hold multiple devices of the same make, model and grade. The device supplied will meet the specifications and condition grade stated in the product listing but may not be the exact device photographed.

Product availability

All products are subject to availability. We may cancel or refund an order if a product becomes unavailable, has been incorrectly listed, or there has been a genuine error in its price or description.

Where this occurs, we will contact you and provide a refund for any amount already paid for the affected product.

Pricing and payment

All prices are displayed in Australian dollars (AUD).

Payment must be made using one of the payment methods available at checkout. Your order is confirmed once payment has been successfully processed and the order has been accepted by Sam’s Spares.

Shipping or delivery charges, where applicable, will be displayed during checkout.

Orders

Please check your order carefully before completing your purchase.

We reserve the right to refuse or cancel an order where we reasonably believe there has been an error, fraudulent activity, misuse of our website or another legitimate reason for doing so.

Nothing in these Terms limits any rights you have under Australian Consumer Law.

Shipping and collection

Available shipping and collection options will be displayed at checkout.

Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control, including delays by carriers.

Customers selecting collection will be advised when their order is ready. Please do not attend to collect an order until you have received confirmation that it is ready.

Warranty, returns and refunds

Our refurbished products are covered by the warranty stated on the relevant product listing or our Warranty Policy.

Your purchase is also protected by consumer guarantees that cannot be excluded under the Australian Consumer Law.

Our Refund and Returns Policy provides further information about returns, faults, refunds, repairs and replacements.

Nothing in our warranty, Refund and Returns Policy or these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under Australian Consumer Law.

Product data

Refurbished devices are processed before resale using Sam’s Spares' data handling and refurbishment procedures.

Customers are responsible for backing up any information they place on a device after receiving it. Sam’s Spares is not responsible for loss of customer data except to the extent liability cannot lawfully be excluded.

Website information

We make reasonable efforts to ensure information on our website, including product specifications, availability and pricing, is accurate.

Occasionally an error may occur. We may correct errors or update information when identified.

Colours and appearance may also vary slightly depending on the screen or device used to view our website.

Acceptable use

You must not use our website for unlawful, fraudulent or malicious purposes, interfere with the operation or security of the website, attempt to gain unauthorised access to our systems, or use the website in a way that infringes the rights of Sam’s Spares or another person.

Intellectual property

Unless otherwise stated, content created by Sam’s Spares on this website, including our branding, written material, graphics and original images, belongs to Sam’s Spares or is used with permission.

You may not reproduce or commercially use this content without our permission.

Third-party services

Our online store is powered by Shopify and may use other third-party services for functions including payments, shipping and website functionality.
